1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and TypeSwitch ("we", "us", "our") governing your access to and use of the TypeSwitch browser extension and related services.

By installing, accessing, or using TypeSwitch, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using TypeSwitch on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

TypeSwitch is a browser extension that provides real-time text translation capabilities within web page input fields. The service:

• Allows you to type text in your native language and translate it to another language
• Works within editable text fields, textareas, and contenteditable elements on web pages
• Uses AI-powered translation via the Google Gemini API
• Supports 60+ languages with automatic source language detection
• Operates on a keyboard shortcut (Ctrl+Shift+Y) or automatic translation modes

TypeSwitch is a paid subscription service. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time. Pricing and subscription terms are available on the Chrome Web Store.

3. License & Usage Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use TypeSwitch on browsers that support Chrome extensions
• Use the translation service for personal and professional communication
• Access updates and improvements as they become available

This license does not include the right to:

• Modify, reverse engineer, or decompile the extension (except as permitted by applicable law)
• Redistribute, sell, or sublicense the extension
• Use the service for any unlawful purpose

4. Usage Restrictions

You agree not to use TypeSwitch to:

• Illegal Activities: Translate content for illegal purposes, including fraud, harassment, or distribution of illegal materials
• Harmful Content: Process or translate content that is defamatory, obscene, hateful, or promotes violence
• Spam or Abuse: Send automated bulk translations or engage in activities that could overload our services
• Circumvent Security: Attempt to bypass, disable, or interfere with security features
• Impersonation: Use translations to impersonate other individuals or entities
• Intellectual Property Violation: Translate content in violation of copyright or other intellectual property rights

5. Privacy & Data

Your privacy is important to us. Our handling of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We do not store your translated text on our servers
• Translation preferences are stored locally in your browser
• Text is processed by Google's Gemini API for translation purposes only
• We comply with the General Data Protection Regulation (GDPR)

6. Third-Party Services

TypeSwitch relies on third-party services to function:

Translations are powered by Google's Gemini 2.0 Flash model. Your use of TypeSwitch is also subject to Google Cloud's Terms of Service.

6.2 Website Compatibility

TypeSwitch interacts with third-party websites. We are not responsible for:

• Changes to websites that may affect TypeSwitch functionality
• Any actions taken by website operators regarding extension usage
• Violations of third-party website terms of service through misuse of translations

7. Intellectual Property

TypeSwitch, including its code, design, and documentation, is protected by copyright and other intellectual property laws. The TypeSwitch name, logo, and branding are our trademarks.

Your Content: You retain all rights to the text you input for translation. By using TypeSwitch, you grant us a limited license to process your text solely for the purpose of providing the translation service.

Translations: Translations generated by TypeSwitch are provided for your use. We make no claim to ownership of translated output.

8. Disclaimer of Warranties

We specifically disclaim:

• Accuracy: While we strive for high-quality translations, we do not guarantee that translations will be error-free, complete, or suitable for any particular purpose
• Availability: Continuous, uninterrupted access to the service
• Compatibility: Functionality on all websites or in all circumstances
• Security: That the service will be free from vulnerabilities or immune to cyber attacks

Professional Use Warning: TypeSwitch translations should not be used as a substitute for professional human translation in legal, medical, financial, or other critical contexts where translation errors could cause harm.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
• Our total liability for any claims arising from or relating to these Terms or TypeSwitch shall not exceed €100

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless TypeSwitch, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of TypeSwitch
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you translate using the service

11. Termination

By You: You may stop using TypeSwitch at any time by uninstalling the extension. This terminates your license under these Terms.

By Us: We may suspend or terminate your access to TypeSwitch at any time, for any reason, including:

• Violation of these Terms
• Conduct that we determine to be harmful to other users or our services
• Discontinuation of the service

Upon termination, your license to use TypeSwitch immediately ends. Sections regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date.

For material changes, we will provide notice through:

• A notification in the extension
• An update to this Terms of Service page

Your continued use of TypeSwitch after changes take effect constitutes acceptance of the modified Terms.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the country where the data controller is established.

For users in the European Economic Area (EEA):

• Nothing in these Terms affects your statutory rights as a consumer under EU law
• You may bring legal proceedings in the courts of your country of residence
• We are subject to the jurisdiction of the courts where we are established

Dispute Resolution: We encourage you to contact us first to resolve any disputes. Most issues can be resolved through informal discussion.
